General Terms and Conditions

The tour operator is America West Motorcycle Tours, 804 E. Main St., Auburn, WA 98002 USA. By signing this terms and conditions form, you agree to the terms and conditions between America West Motorcycle Tours and yourself (participant). America West Motorcycle Tours cannot accept a participant without a signed terms and conditions form. Please read the terms and conditions carefully.

A reservation is complete for a participant when the participant submits a signed contract and deposit. Payment in full is required 60 days before the start of the tour. Each participant is required to sign a release and waiver form of rights before the tour starts. America West Motorcycle Tours cannot accept a participant without a signed release and waiver form.

A nonrefundable deposit of US$500 is required at the time of booking. This deposit secures a motorcycle and hotel bookings. The balance is due 60 days before the tour starts. If the total balance is not received 60 days before the tour start, America West Motorcycle Tours reserves the right to cancel the reservation and the participant loses the deposit or transfers the deposit to a tour booking for the following year.

America West Motorcycle Tours provides motorcycles as part of the tour package. The pictures of the motorcycles in literature or on this website may not always represent the exact version of the motorcycles provided. Please email or call if you need specific or customization information on exact motorcycle versions. America West Motorcycle Tours reserves the right to substitute a motorcycle confirmed to a participant, but will make every effort to contact the participant prior to any substitution. Most participants ride the motorcycle that is confirmed for them. However, certain uncontrollable situations (such as mechanical problems, damage or theft) may require a substitution. Situations beyond our control may arise which make it necessary for us to change tour itineraries or make substitutions regarding hotels, cities, guides and other travel arrangements. We do not assume responsibility or liability for any resulting losses, expenses or inconvenience to the participant. America West Motorcycle Tours is not required to make refunds once the tour commences, regardless of the reason for the participant’s inability to complete his tour.

America West Motorcycle Tours is responsible for providing the services listed in the tour descriptions according to the local standards, however due to situations beyond our control (such as road work, hotel closures, or weather), America West Motorcycle Tours reserves the right without prior notice to withdraw any part or all of a tour, or to make such changes as may be necessary. It is agreed and understood that the Owners, Operators and Agents of this tour, including America West Motorcycle Tours, are not the guardians of the participant’s safety and cannot be held liable in any way for any occurrence in connection with any activity in connection with the tour which might result in injury, death or other damage to the participant, his property, his family, or heirs. America West Motorcycle Tours is not responsible for any damage caused to third parties due to the participant’s activities during the tour.

Motorcycles

A damage deposit/deductible of $1000 must be paid to America West Motorcycle Tours at the beginning of the motorcycle rental period. The deposit will be held until the undamaged motorcycle is returned in acceptable condition. If the motorcycle is undamaged, the deposit will be refunded at that time. The rental period is not interrupted due to damage to the motorcycle or the inability of the participant to ride the motorcycle. During the rental period, America West Motorcycle Tours is not obligated to replace a damaged motorcycle.

Insurance

America West requires that you submit a deposit of $1000 for the motorcycle and purchase Liability, Comprehensive and Collision Insurance at $15 per day for every day you ride the motorcycle.

If the motorcycle is returned undamaged, the Insurance Company will return your $1000 deposit. If the motorcycle is returned with minor damage, you can choose to pay us directly and the Insurance Company will return your $1000 deposit. If the motorcycle is returned heavily damaged, you will lose your $1000 deposit.

You will not receive a refund of your $15 per day fee. It pays for your insurance.

Additionally the insurance provider will cover the rider for $500 in medical payments in case you are injured. Passengers are not covered for medical payments. We recommend that you purchase travel heath insurance for you and your passenger in case you need medical attention in the US.

Recovery

America West will do it’s utmost to provide for recovery of the motorcycle for any malfunction other than tire punctures (see below). Due to some of the remote conditions of our routes, America West does not guarantee that recovery and repair will take place on the same day. America West maintains its motorcycles to the highest standards, but will not be responsible for whole or partial tour refunds due lost days as a result of motorcycle malfunction.

Tires

America West is not responsible for punctured or damaged tires due to road conditions. America West will be happy to advise you where to get repairs, however, America West is not responsible for service and replacement of tires.

Cancellation

Cancellations received less than 60 days prior to the date of tour start will be subject to loss of 50% of the tour fee. Cancellations received less than 30 days prior to departure will be subject to loss of the entire tour fee. Lost tour fees due to cancellation can be transferred to a tour booking for the following year.

Miscellaneous

If the participant does not comply with traffic laws, America West Motorcycle Tours reserves the right to revoke this contract and remove the participant’s rental motorcycle. A participant is responsible for all traffic tickets received during the tour. A service charge will apply for all unpaid tickets. Participants agree to not cause any damage to natural surrounding or third parties through their actions while riding their motorcycles. In the event a participant repeatedly ignores rules or causes others to feel threatened by their actions, America West Motorcycle Tours reserves the right to revoke this contract and remove the participant’s rental motorcycle. Every participant needs a valid motorcycle license to take part in a tour. The participant is responsible for complying with passport and visa regulations and takes responsibility for consequences resulting from non-compliance.

A participant is fully aware of the risks and dangers involved in outdoor activities like swimming, white water rafting, rock climbing or any other activity potentially suggested as a supplemental activity to the tour and accepts full liability.

Fares quoted by America West Motorcycle Tours, its agents or publications are those in effect at time of printing. On rare occasions, due to situations beyond our control, America West Motorcycle Tours reserves the right to change tour prices any time prior to 60 days before departure. America West Motorcycle Tours reserves the right to correct printing errors or calculation mistakes at any time. Discounts offered by America West Motorcycle Tours cannot be combined with other existing discounts.

America West Motorcycle Tours recommends that guests take out adequate travel, health and accident insurance, as well as trip cancellation insurance.

Photos and videos produced by America West Motorcycle Tours are the property of America West Motorcycle Tours. The copyrights rest with America West Motorcycle Tours. America West Motorcycle Tours can use all such material for advertising and marketing purposes, including images in which participants can be recognized, without any charge from the participant. Participants who submit photos to America West Motorcycle Tours agree to allow the use of such photos by America West Motorcycle Tours for advertising and marketing purposes.

America West Motorcycle Tours attempts to schedule its tours at a time when the weather is pleasant for motorcycling. Many tours pass through areas where weather conditions can change. America West Motorcycle Tours is not liable for unpleasant weather conditions and no refunds will be made for such conditions.
